Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of our services, including Video Marketing Creation and WordPress Website Development (“Services”), provided by Rikiez.com (“we,” “us,” or “our”). By using our Services, you agree to be bound by these Terms.
1. Services Provided
We offer Video Marketing Creation and WordPress Website Development services, including but not limited to:
- Video Marketing Creation: Planning, editing, and delivery of video content as agreed upon in a separate project proposal or agreement. (Note: This service does not involve filming by Rikiez.com. We will provide Royalty-Free Stock Footage and Images, and Royalty-Free Music if the client does not provide their own.)
- WordPress Website Development: Design, development, and implementation of websites, including content integration, graphic design, and technical setup, as agreed upon in a separate project proposal or agreement.
- Related Services: Any other related services as detailed in the project proposal or agreement.
2. Client Responsibilities
- You are responsible for providing us with all necessary information, materials, and approvals required to complete the Services. This includes, but is not limited to, branding guidelines, content, logos, and feedback. For video marketing creation, this includes providing specific instructions and preferences if you choose not to use our royalty-free options.
- You agree to cooperate with us in a timely manner to ensure the project stays on schedule.
- You are responsible for reviewing and approving all deliverables provided by us.
- You are responsible for ensuring that you have the necessary rights and permissions for any content you provide to us, including text, images, video, and audio.
3. Payment Terms
- Full upfront payment is required before work commences on any project.
4. Intellectual Property
- Unless otherwise agreed in the project proposal or agreement, we retain ownership of all intellectual property rights in any materials created by us, including but not limited to edited video content, website design, and code (excluding royalty-free assets provided by us under license).
- We grant you a license to use the final deliverables for the purposes outlined in the project proposal or agreement. This license includes the right to use the royalty-free stock footage, images, and music provided by us within the final delivered video.
- You retain ownership of any intellectual property rights in the content you provide to us.
- We reserve the right to showcase completed projects in our portfolio unless otherwise agreed upon in writing.
5. Revisions and Changes
- The number of revisions included in the project will be specified in the project proposal or agreement.
- Additional revisions or changes beyond the agreed-upon scope may be subject to additional charges.
- We will make reasonable efforts to accommodate your requests for changes, but we reserve the right to refuse changes that are outside the original scope of the project or that would significantly impact the project timeline or cost.
6. Project Timeline
- Project timelines will be outlined in the project proposal or agreement.
- We will make reasonable efforts to adhere to the agreed-upon timeline, but we are not liable for delays caused by factors beyond our control, including but not limited to, your failure to provide timely feedback or materials, changes to the project scope, or force majeure events.
7. Cancellation, Refund, and Returns Policy
- Cancellation by Client: If you cancel the project after full payment has been made but before work commences, a full refund may be issued, subject to a review of any resources already allocated to the project. If cancellation occurs after work has begun, a partial refund may be issued at our discretion, based on the amount of work completed
- Cancellation by Rikiez.com: We reserve the right to cancel the project if you breach these Terms or the project proposal or agreement, or if you fail to provide us with the necessary cooperation or information. In such cases, a partial refund may be issued at our discretion, based on the amount of work completed.
- Refunds and Returns: Due to the nature of digital creative services, which involve significant upfront work and time allocation, we do not typically offer refunds or returns once work has commenced. Any issues with the final deliverables should be communicated to us promptly, and we will make reasonable efforts to address them within the scope of the agreed-upon revisions. The terms of the cancellation agreement above will apply to any requests for refunds.
8. Confidentiality
- Both parties agree to hold each other’s confidential information in confidence. Confidential information includes any information that is designated as confidential or that reasonably should be understood to be confidential.
- This obligation of confidentiality will continue for a lifetime after the termination of the project.
9. Warranty and Disclaimer
- We warrant that our Services will be performed in a professional and workmanlike manner.
- We do not warrant that our Services will be error-free or that your website or video will achieve any specific results.
- To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
10. Limitation of Liability
- Our liability to you for any claim arising out of or relating to our Services will be limited to the amount paid by you for the Services.
- In no event will we be liable for any indirect, incidental, consequential, or special damages, including but not limited to, lost profits, lost revenue, or loss of data.
11. Indemnification
- You agree to indemnify and hold Rikiez.com harmless from any and all claims, damages, liabilities, and expenses (including attorneys’ fees) arising out of or relating to your use of our Services, your content, or your breach of these Terms.
12. Dispute Resolution
- Any dispute arising out of or relating to these Terms shall be resolved through mediation. If mediation fails to resolve the dispute within a reasonable timeframe, then the parties may pursue other available legal remedies.
13. Entire Agreement
- These Terms, together with the project proposal or agreement, constitute the entire agreement between you and Rikiez.com with respect to the Services.
14. Amendments
- We may amend these Terms from time to time. Any changes will be effective upon posting the revised Terms on our website. Your continued use of our Services after the posting of changes constitutes your acceptance of the updated Terms.
